KidDream ("we", "our", or "us") is operated by GD Creative Lab (Gokhan Dedeler), an entity registered under the laws of Poland (collectively referred to as the "Data Controller"). 2. Data We Collect

We collect and process the following categories of data in connection with your use of our service:

  • Parent/guardian email address (for authentication, billing, and system communications)
  • Child profile information provided by parents (such as name and age, specifically targeted for children aged 3 to 8)
  • Voice recordings uploaded by parents or created with the child's participation
  • Children's drawings and images uploaded by parents
  • Dream descriptions and story inputs
  • Generated stories, audio, and creative content
  • Usage data, device information, and subscription status

3. Purpose of Processing

We process your personal and technical data to provide, maintain, and optimize our services. Most notably, we use this information to create personalized stories and creative content based on children's dreams, drawings, and voice recordings.

Under the General Data Protection Regulation (GDPR), we process your data under the following legal bases:

  • Performance of a Contract (Art. 6(1)(b) GDPR): To deliver the core personalized creative content and handle your transactions.
  • Consent (Art. 6(1)(a) GDPR): For processing child-related media (such as voice and drawings) explicitly provided by the parent or guardian.
  • Legitimate Interests (Art. 6(1)(f) GDPR): To monitor system security, detect fraud, and optimize application stability.

4. AI Processing & Subprocessors

To generate personalized dream interpretations, narratives, and creative content, the text, drawings, and voice inputs you provide are securely transmitted to third-party artificial intelligence API providers (such as OpenAI LLC).

We contractually ensure that our AI providers treat this data in strict confidence. No data sent to our AI subprocessors is used by them to train their public AI models. To safeguard your privacy, we strip personally identifiable metadata from these API payloads where technically feasible.

5. Strictly Entertainment Purpose & No Psychological Advice

CRITICAL NOTICE: KidDream is strictly an interactive entertainment application. The AI-generated dream interpretations, stories, and insights are completely automated, speculative, and fictional.

They do not, under any circumstances, constitute medical, psychiatric, psychological, pediatric, or clinical advice, diagnosis, or therapy. The service must not be used as a substitute for professional mental health guidance. If your child is experiencing nightmares, severe anxiety, sleep disorders, or any distress, you must consult a licensed medical or psychological professional.

6. Disclaimer of AI Accuracy & Output Responsibility

By using this application, you acknowledge that generative AI systems are inherently unpredictable. We do not inspect every individual AI response in real-time.

Consequently, we do not warrant or guarantee that AI-generated interpretations will be accurate, appropriate, safe, or contextually fitting for every child. We disclaim any and all liability for emotional distress, confusion, offense, or decisions made by parents or guardians based on the texts generated by the AI models.

7. Data Sharing and Disclosures

We do not sell, rent, or trade your personal data to third parties. We share limited personal data only with trusted service providers essential for our operations:

  • Cloud Infrastructure & Hosting (e.g., Google Cloud, Firebase)
  • Payment Processors (e.g., Stripe, Paddle)
  • AI Integration Partners (e.g., OpenAI)
  • Performance and Security Monitoring Tools

All third parties are bound by Data Processing Agreements (DPAs) to ensure compliance with global data protection laws.

8. Children's Privacy (COPPA & GDPR-K)

The Service is designed to process creative content suitable for children, with a specific focus on children aged 3 to 8 years old. However, the direct user of the application must always be an adult.

KidDream is designed for parents and guardians. Parents create accounts and control the content stored in the application. We may process information related to children, such as names, ages, voice recordings, drawings, and stories, only when provided by a parent or guardian.

We do not knowingly collect personal data directly from children under 13 (or under 16 in the European Economic Area) without verifiable parental consent. If you believe a child under these ages has directly registered an account or provided personal data without parent/guardian supervision, please contact us immediately at support@kiddream.app so we can remove the data.

9. International Data Transfers

Our services are globally distributed. Therefore, personal data may be transferred to and processed in countries outside the European Economic Area (EEA), including the United States. To guarantee that your data is handled with an equivalent level of protection, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission, and verify that our partners maintain active adequacy frameworks.

10. Data Retention

We retain your personal data only as long as your account is active, as necessary to provide the services, or as required by applicable laws (such as tax compliance and dispute resolution). Upon account deletion, user inputs and account profiles are either permanently deleted or rendered fully anonymous in accordance with our security guidelines.

11. Your Data Subject Rights

Depending on your jurisdiction (such as under the GDPR or CCPA/CPRA), you possess distinct rights regarding your personal information, including:

  • The Right to Access & Portability: Obtain a copy of your personal data.
  • The Right to Rectification: Request correction of inaccurate information.
  • The Right to Erasure ("Right to be Forgotten"): Request deletion of your account and related data.
  • The Right to Restrict or Object: Oppose or restrict specific data processing.
  • The Right to Withdraw Consent: Revoke consent at any time where processing is consent-based.

12. Software Warranty & Developer Indemnification

To the maximum extent permitted by applicable law, KidDream, its underlying source code, APIs, and interfaces are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.

LIMITATION OF PERSONAL LIABILITY: Under no circumstances shall the individual software developers, designers, engineers, creators, or founders of KidDream be personally liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, server outages, database compromises, security breaches, loss of usage data, service interruption, or any physical, emotional, or psychological distress).

By using this application, you voluntarily release and forever discharge the individual technical developers of KidDream from any claims, liabilities, or lawsuits arising from your use of the application.

13. Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. Any material changes will be communicated to you by updating the "Last Updated" date at the top of this policy and, where appropriate, through inside-app notices or direct email communications.
